would anyone know the chances of disputing an infringement notice where a detail concerning the colour of the car is wrong. for example: the notice states the car to be a BLUE sedan, when in fact the car is clearly a SILVER sedan. no other information is deemed incorrect.

in other non legal news:

the monkey is quite ill. spent almost 24hours straight without sleep looking after him as a continuously vomited. a brief trip to emergency last night got us nowhere as we were quite quickly forgotten about amidst the hordes of other concerned parents with their sickly kiddlies. he appears much better today, but still quite lethargic and not quite ready for solid food. but, i'm pleased that he's keeping his fluids down at least, so he's filling himself up on that. not sure what it is, but rumour around the emergency waiting room was a hint of gastric virus sneaking its way underneath the the heightened flu sensors. there was a little girl who had the exact same symptoms as the monkey, and she was sent home before we got a chance to be considered again. so we just upped and took the monkey home. seems to have been a good idea, as he's not as stressed as he would have been had we stayed.

oh well,must return to my coffee and hope the printer is up to task, finally.

I was once told that any detail incorrect on an infringement notice makes it not enforceable, but the specific example cited was if they get your name or address wrong or misspelled. I don't know about the details of the car being wrong...

it depends on who issued it...if it's the Police then they are obligated to check the rego sticker and their database to verify the vehicle's owner and address etc.

If it's the Council, they don't have to verify squat and the details of the vehicle can be up to their 'interpretation'. Blue and silver can be easily confused...but in my case they noted my vehicle as blue when it's green...no where near remotely similar.

police issue infringement. rego sticker states "SIL" as the colour of the car. so 'interpretation' should not be in question.

what to do.

just to double check with Police HQ 3364 6464 and their traffic division as to whether it is void due to incorrect details...

having been in the exact same situation (wrong colour on ticket etc) it is difficult to dispute if the ticket was issued by the Council. They don't have to check the rego sticker (which clearly states what colour the vehicle is) and instead can rely on 'interpretation'.

I still took my dispute to court because I could prove that they issued it incorrectly and it was dropped since they couldn't produce the officer to wrote the ticket.

I'm also disputing another ticket - what was the circumstances cos you may be able to argue the toss if you really believe you shouldn't have been issued it in the first place.

Re: car. what was the infringement? and if it's quite obviously silver, not blue, then it cant hurt to contest it anyway. you can always try. and who knows, it may call into question the competancy of the attending officer, councilman. it works for chain of evidence.
